DEFENSE VERDICT OBTAINED IN MEDICAL MALPRACTICE CASE IN KINGS COUNTY

Henry Nelkin, a partner, obtained a defense verdict after a three-week trial in Supreme Court, Kings County.  The client was a urologist who repaired a uretopelvic obstruction and removed kidney stones from his patient.  The patient brought suit claiming that the doctor caused unnecessary scarring, and the surgery resulted in an abdominal hernia.  The case was primarily founded upon failure to provide informed consent, and the jury found that the plaintiff had failed to prove her case.  It should be noted that an offer was made to settle the case prior to trial in the amount of $750,000, and this amount was rejected by the plaintiff
