Michael Jenks recently was victorious in a motion for summary judgment dismissing all claims against his client, a surgeon, who assisted in emergency surgery due to a gunshot wound to the plaintiff’s leg which would later result in necessary amputation. Mike successfully argued that his client’s care and treatment of the patient conformed with good and accepted medical practice. In support, Mike offered evidence including expert testimony which confirmed that the plaintiff not only received proper medical care, but the doctor used his skill and expertise during this emergency procedure to stabilize the plaintiff, which ultimately saved the plaintiff’s life.
